The HIPAA Badge Problem

Search for any AI tool marketed to healthcare and you'll find a HIPAA badge on the landing page. It's become table stakes — every vendor claims compliance. But here's what most practices don't realize: there is no official HIPAA certification. No government body certifies products as "HIPAA compliant." That badge on the website? It's self-declared.

This doesn't mean HIPAA compliance is meaningless — it means you need to ask the right questions and know the red flags. Because using a non-compliant AI tool with patient data isn't just risky — it's a federal violation with fines up to $1.5 million per incident.

What HIPAA Actually Requires for AI Tools

HIPAA has specific requirements for any technology that touches Protected Health Information (PHI). For AI tools in healthcare, here's what compliance actually looks like:

1. Business Associate Agreement (BAA)

This is the baseline. If an AI vendor processes, stores, or transmits PHI, they are a Business Associate under HIPAA. They must sign a BAA with your practice. No BAA = no deal. Period.

Red flag: If a vendor says "we don't need a BAA because we don't store data" or "our terms of service cover it," walk away. The BAA is a legally binding document separate from the ToS, and it's non-negotiable under HIPAA.

2. Encryption Standards

PHI must be encrypted both in transit (when data moves between your systems and the AI) and at rest (when data is stored on their servers). The standard is AES-256 encryption at rest and TLS 1.2+ in transit.

Red flag: If a vendor can't tell you their specific encryption standards, or if their tool transmits data over HTTP instead of HTTPS, they're not compliant.

3. Access Controls

HIPAA requires role-based access controls. Only authorized personnel should be able to access PHI. For AI tools, this means:

  • Individual user accounts with unique credentials (no shared logins)
  • Role-based permissions (front desk sees different data than providers)
  • Automatic session timeouts
  • Audit logs of who accessed what and when

4. Data Handling and Retention

Where does your patient data go when the AI processes it? How long is it kept? Can the vendor access it? These aren't hypothetical questions — they're HIPAA requirements.

A compliant AI vendor should be able to tell you:

  • Exactly where data is processed (which data centers, which country)
  • How long data is retained and when it's deleted
  • Whether human employees can access your patient data (and under what circumstances)
  • Whether patient data is used to train or improve AI models (it shouldn't be, without explicit authorization)

5. Breach Notification

If a data breach occurs, HIPAA requires notification within 60 days. Your BAA should specify the vendor's obligation to notify you of any breach or security incident, the timeline for notification, and what information they'll provide.

The AI-Specific Risks Most Vendors Ignore

AI tools introduce unique HIPAA risks that traditional software doesn't have:

Model training on PHI. Some AI vendors use customer data to train and improve their models. This means your patients' information could influence outputs shown to other users. A HIPAA-compliant AI vendor should explicitly state that patient data is never used for model training.

Third-party AI providers. Many healthcare AI tools are wrappers around OpenAI, Google, or other general-purpose AI APIs. The question is: does that third-party provider also have a BAA in place? If your "HIPAA compliant" vendor sends patient data to a non-compliant API, the entire chain is broken.

Prompt injection and data leakage. AI chatbots and tools that process natural language can potentially be manipulated to reveal data from other sessions or users. Proper data isolation — where each practice's data is completely separated — is essential.

Audio and voice data. AI scribes and voice agents process audio recordings of patient encounters. Audio is PHI. It needs the same encryption, access control, and retention policies as any other patient data. Some vendors retain audio indefinitely for "quality improvement" — that's a compliance risk.

The Due Diligence Checklist

Before adopting any AI tool for your practice, ask these questions:

  • Will you sign a Business Associate Agreement?
  • What encryption do you use in transit and at rest?
  • Where is data processed and stored? (Must be US-based for most practices)
  • Do you use any third-party AI APIs? If so, do they have BAAs in place?
  • Is patient data ever used for model training or improvement?
  • How long is data retained? What's your deletion policy?
  • Can your employees access our patient data? Under what circumstances?
  • Do you have SOC 2 Type II certification?
  • What's your breach notification process and timeline?
  • Can you provide audit logs of data access?

Why It Matters More Than Ever

OCR (the Office for Civil Rights, which enforces HIPAA) has been increasing enforcement actions year over year. In 2025 alone, settlements exceeded $15 million across healthcare organizations. The trend is clear: regulators are paying attention to how practices use new technology, including AI.
